TITLE: Paymentfor Program Services

POLICY

Code of Iowa chapter 905.14 states, “1. A person placed on probation or parole and subject to supervision by a district department shall be required to pay an enrollment fee of three hundred dollars to the district department to offset the costs of supervision. 2. The fees established pursuant to this section shall not be waived by the sentencing court. Each district department shall retain fees collected for administrative and program services. 3. The Department of Corrections may adopt rules for the administration of this section. If adopted, the rules shall include a provision for waiving the collection of fees for persons determined to be unable to pay.”

Those offenders residing at the residential facilities are assessed a daily fee to pay for room and board. The amount of this fee is determined by the Board of Directors for the Fifth Judicial District Department of Correctional Services. The fee amount for those residing in the Probation and Work Release units will be $16 per day. For those offenders residing in the OWI unit the fee will be $18 per day. These current fees were approved by a full voice vote of the Executive Committee of the Board of Directors for the Fifth Judicial District Department of Correctional Services on July 30, 2008.

Offenders may be assessed a reduced room and board rate for day reporting. This could be reduced to a half rate if the offender is not residing in the facility at any time but returning to the facility for services or they could be assessed only for the days they do reside in the facility. Room and board may also be waived with the approval of the Assistant Director if an offender is not able to gain suitable employment. With the approval of the Assistant Director offenders may also perform work within the facility for room and board credit.

Offenders residing at the residential facilities are also assessed a one-time $30.00 linen fee to cover the costs of linens given to each offender upon entering the facility. Offenders residing at the residential facilities may be assessed a one-time $7.00 padlock fee to cover the cost of the padlock given to offenders needing a padlock upon entering the facility.

PROCEDURES

When an offender is placed on probation or parole, the Department staff will assess the enrollment (supervision) fee to the offender. Staff will seek to attain payment when the offender signs his/her initial paperwork. Payments will be recorded in the Department's Fee Collection System and a receipt will be given to the offender. Monies collected will be appropriately placed in the money repository in each work area where money is collected. Money will be gathered and reconciled daily and deposited in the bank at least weekly.

Offenders at the residential facilities will be assessed the designated rent per day from the date of entry until the date of departure from the facilities. Offenders will also be assessed the linen fee upon entry into the residential facility and assessed the padlock fee if applicable.

Only the District Director, the Assistant District Director of Field Services, and the Assistant District Director of Residential Services has the authority to waive, due to offender indigence, the enrollment (supervision) fee and/or facility rent.
