TITLE: Providing For Provisional Appointments

POLICY

The Code of Iowa Chapter 20.12 states, “It shall be unlawful for any public employee or any employee organization, directly or indirectly, to induce, instigate, encourage, authorize, ratify or participate in a strike against any public employer”.

Per the 2005-2007 Collective Bargaining Agreement Between State of Iowa and American Federation of State, County, and Municipal Employees, Council 61 AFL-CIO, Article III, Management Rights, pages 13 and 14, the District has the right to “Hire, promote, demote, transfer, assign, and retain employees in positions within its agencies”, “Maintain the efficiency of governmental operations”, and “Determine and implement methods, means, assignments and personnel by which the Employer’s operations are to be conducted”. The District will fill full and part-time positions necessary to meet the needs of its operations, funding permitting.
